Terms of Service

These Terms of Service (the "Terms") are a binding agreement between you and Touchcast / [YOU] on AI ("youonai.ai," "we," "us," or "our") governing your access to and use of the youonai.ai website, applications, content, podcasts, newsletters, and any subscription unlocked by a redemption code (together, the "Service"). Please read them carefully. By creating an account, redeeming a code, or using the Service, you agree to these Terms.

This document is a thorough, good-faith draft template. Before you rely on it commercially, have it reviewed by qualified legal counsel and reconciled with your actual billing, jurisdiction, and privacy practices.

1Acceptance of these Terms

By redeeming a code, creating an account, or otherwise accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Service. If you are using the Service on behalf of an organization, you represent that you are authorized to bind that organization, and "you" refers to that organization.

2What the Service is

[YOU] on AI is an editorial learning environment about artificial intelligence, built around the book [YOU] on AI. A subscription provides access to our published works, which may include: the Library of "[Thinker] on AI" volumes, the illustrated Field Guide, the Great Debates, the book, and the live [PULSE] on AI newsroom together with its newsletters and podcasts. The specific features, titles, and quantities available are described on the site and may change, expand, or be retired over time at our discretion.

3Eligibility & your account

You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the Service. To unlock and keep your access, you create an account, which you may do with an email address or a supported single-sign-on provider (for example, Google or Apple) through our authentication provider.

4Redemption codes & annual access

A redemption code is a unique credential that unlocks a subscription to the Service for the period stated at issuance (typically twelve months of annual access) when applied to a valid account.

5Subscriptions, renewal & payment

Access unlocked by a redemption code is granted for its stated term and, by default, does not auto-renew — when the term ends, you may continue by redeeming a new code or by purchasing a subscription directly. Where you instead purchase a paid subscription, the price, billing cycle, and any auto-renewal terms are disclosed at checkout; recurring subscriptions renew automatically until cancelled, and you authorize us and our payment processor to charge your payment method accordingly. Taxes may apply. We may change prices on a going-forward basis with notice.

6Cancellation & refunds

You may stop using the Service at any time and, for paid recurring subscriptions, cancel renewal from your account settings; cancellation takes effect at the end of the current paid period and you retain access until then. Except where required by law, payments and redeemed codes are non-refundable, and partial periods are not refunded. We may offer refunds at our discretion. Nothing here limits any non-waivable statutory rights you may have, including any applicable cooling-off or withdrawal rights.

7Your licence to the content

Subject to these Terms and your active subscription, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and view the content for your own non-commercial learning and enjoyment. This licence does not transfer any ownership and ends when your subscription ends or these Terms are terminated.

You agree not to, and not to permit anyone to:

9Intellectual property

The Service and all of its content — text, illustrations and engravings, audio, the "edgecut" visual system, designs, software, trademarks, and the [YOU] on AI and [PULSE] on AI names and marks — are owned by or licensed to us and are protected by intellectual-property laws. All rights not expressly granted to you are reserved. Quotations and references to third-party thinkers, works, and reported facts are used for commentary, criticism, education, and reporting; their respective owners retain their rights.

10Editorial & AI-assisted content; no advice

The Service is a work of editorial commentary and education — "AI news read through the lens of a book." Some content is produced with the assistance of AI systems and is reviewed within an editorial process; despite our care, content may contain errors, omissions, or opinions, and reported facts reflect a point in time. The Service is provided for general informational and educational purposes only and is not professional advice — not investment, financial, legal, medical, or other professional advice — and must not be relied upon as such. Always seek a qualified professional for decisions that matter.

11Your content & feedback

If the Service lets you submit notes, comments, questions, or other material ("User Content"), you keep your ownership but grant us a worldwide, royalty-free, sublicensable licence to host, use, reproduce, and display it as needed to operate and improve the Service. You are responsible for your User Content and represent that you have the rights to submit it. If you send us suggestions or feedback, we may use them freely without obligation to you.

12Communications & newsletters

By creating an account you agree we may send you service and transactional messages. If you opt in to newsletters (such as the [PULSE] Daily or Weekly), you consent to receive them; you can unsubscribe at any time using the link in any issue or in your settings. Managing your podcast subscriptions happens in your podcast app via the feeds we publish.

13Third-party services

The Service relies on third parties — for example, an authentication provider for sign-in, a payment processor for purchases, email and podcast-distribution providers, and the podcast apps you use to subscribe. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them. Links to third-party sites are provided for convenience and are not endorsements.

14Privacy

We handle personal data as described in our Privacy Policy. In short, we collect what we need to provide the Service — account details, subscription status, and usage — and we do not sell your personal information. Please review the Privacy Policy for the full picture, including your rights and choices.

15Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability. We do not warrant that the Service will be uninterrupted, secure, error-free, or that any content is complete or current. Some jurisdictions do not allow certain disclaimers, so some may not apply to you.

16Limitation of liability

To the maximum extent permitted by law, we and our affiliates, suppliers, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising from or related to your use of (or inability to use) the Service. Our total liability for all claims relating to the Service is limited to the greater of (a) the amount you paid us for the Service in the twelve months before the claim, or (b) USD 50. Nothing here limits liability that cannot be limited by law.

You agree to indemnify and hold harmless youonai.ai and its affiliates, officers, and staff from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, or your infringement of any third-party right.

18Suspension & termination

We may suspend or terminate your access, with or without notice, if you breach these Terms, if we suspect fraud or abuse, if required by law, or to protect the Service or other users. You may stop using the Service at any time. On termination, your licence ends and you must stop using the content; sections that by their nature should survive (such as IP, disclaimers, limitation of liability, indemnification, and governing law) will survive.

19Changes to the Service & these Terms

We are always building. We may modify, add, or discontinue features or content at any time. We may also update these Terms; if we make material changes, we will take reasonable steps to notify you (for example, by posting a new effective date or by email). Your continued use after changes take effect means you accept the updated Terms. If you do not agree, stop using the Service.

20Governing law & disputes

These Terms are governed by the laws of the State of New York, USA, without regard to its conflict-of-laws rules, and you and we submit to the exclusive jurisdiction of the state and federal courts located in New York County, New York, except where applicable law gives you the right to bring a claim elsewhere. You agree to first try to resolve any dispute informally by contacting us. (If you intend to require arbitration or a class-action waiver, add that here after review by counsel.)
